1. Acceptance of Terms

By accessing or using InsightMatter Agency Management System ("IM-AMS", "we", "us", or "our"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the platform or its services.

2. Service Description

IM-AMS is a business operating system for home care agencies, providing scheduling, staff management, billing, care documentation, and an optional Open Case Pool module that connects agencies with pre-approved caregivers.

3. SMS Messaging Terms

3.1 Opt-In. By opting in to SMS notifications, you provide express written consent to receive text messages from IM-AMS and your associated agency related to open case opportunities, case assignments, and case status updates. Consent is not a condition of using the platform.

3.2 Message Types. You will receive the following types of messages:

  • Alerts when a caregiver expresses interest in an open case
  • Notifications when you are selected for a case assignment
  • Notifications when a case you expressed interest in has been filled
  • Alerts when a new case matching your criteria is posted

3.3 Message Frequency. Message frequency varies based on case activity and agency posting volume. Typically 1–10 messages per week.

3.4 Opt-Out. You may opt out of SMS messages at any time by replying STOP to any message, updating your preferences in your profile, or contacting your agency administrator. After opting out, you will receive no further SMS messages except a one-time confirmation of your opt-out.

3.5 Help. Reply HELP at any time for assistance with SMS messaging.

3.6 Carrier Fees. Message and data rates may apply. Check with your wireless carrier for details.

3.7 Carrier Liability. IM-AMS and its messaging provider (Twilio) are not liable for delayed or undelivered messages, nor for any carrier-related issues.

3.8 Content Restrictions. SMS messages will never contain client-identifying information, protected health information (PHI), or clinical data. Messages are limited to case references and dashboard action prompts only.

4. User Responsibilities

Users are responsible for maintaining accurate contact information, including mobile phone numbers, and for ensuring they have proper authorization to receive SMS messages at the number provided.

5. Privacy

Your use of IM-AMS is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including mobile phone numbers and SMS consent.

6. Limitation of Liability

IM-AMS is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from the use of the platform or SMS messaging services.

7. Changes to Terms

We may update these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms.
